AUSTIN — A controversial bill discussed Tuesday in Texas could impose fines on schools if teachers refer to students by their gender identity or preferred pronouns, rather than their biological sex. House Bill 1655, proposed by Republican Rep. Nathan “Nate” Schatzline, necessitates that public school boards ban any employee from “assisting” a student’s social transition, which may include changes in name, pronouns, or attire.

Schatzline, who claims the bill aims to prevent teachers from “hiding information from parents,” asserts that this legislation is crucial to curtail what he describes as “deceptive” practices that lead to mental health issues among children. He emphasized that discussions about gender identity should occur at home, not in the classroom, asserting that it’s a matter of parental rights.

Critics of the bill express concern that it could jeopardize the mental health and well-being of LGBTQ students. During the House Public Education Committee hearing, Rep. John Bryant, a Democrat, questioned the bill’s implications for teachers responding to parental requests that differ from Schatzline’s views. He argued that the legislation might overlook the nuanced realities of student and parent needs, particularly when it comes to respectful name usage.

Supporters of the bill argue for parental consent in any gender transitioning, asserting that parents should be informed about significant changes in how their children are addressed at school. Testimonies from supporters included anecdotal accounts of confusion and misunderstandings related to students’ identity and the teachers’ roles in those contexts.

Opponents, including educators and LGBTQ advocates, warn that such legislation will endanger vulnerable students, increasing risks of bullying and mental health challenges. They claim restricting teachers from supporting students in their identity fosters a hostile educational environment that could hinder those students’ success. Critics argue that simple acts of respect, like affirming a preferred name, should not be subject to penalties, reflecting broader societal issues regarding acceptance and understanding of gender diversity.
