Appeals Court Denies Trump’s Request to Revoke Status for 400,000 Migrants


The Trump administration’s immigration policy has faced significant legal challenges, particularly regarding the revocation of temporary legal status for hundreds of thousands of migrants from Cuba, Haiti, Nicaragua, and Venezuela. The 1st U.S. Circuit Court of Appeals recently upheld a lower court’s ruling that blocked the Department of Homeland Security (DHS) from prematurely ending a two-year “parole” status granted to these individuals under President Biden’s administration.

Homeland Security Secretary Kristi Noem argued for the authority to terminate this status, claiming it forced the U.S. to retain noncitizens against its will. However, the appellate court, consisting entirely of judges appointed by Democratic presidents, ruled that Noem had not demonstrated a strong legal basis for her actions. Karen Tumlin, a lawyer from the Justice Action Center, criticized DHS’s move as “reckless and illegal,” while the administration is considering an appeal to the U.S. Supreme Court.

The case centers on a lawsuit filed by immigrant rights advocates challenging the DHS’s decision to pause various migration programs initiated under Biden, which facilitated the entry of migrants from several countries. On March 25, the DHS announced plans to terminate the parole status for around 400,000 migrants. This led U.S. District Judge Indira Talwani to issue a halt on April 25, citing the agency’s failure to provide a case-by-case review for those affected and asserting that DHS had committed a legal error.

The situation highlights the ongoing conflict between the Trump administration’s hardline immigration stance and the legal challenges posed by advocates for immigrant rights.
