Federal Government Restores Visa Status for International Students Amid Legal Battles
On Friday, the federal government announced it is restoring the legal status of numerous international students holding visas in the U.S., although officials indicated that this action may be temporary. Earlier this month, over 1,000 international student visas were unexpectedly revoked at various college campuses nationwide, prompting a wave of legal challenges across at least 23 states. Currently, 17 temporary restraining orders have been issued, with more than 40 lawsuits still ongoing.
The Justice Department stated it would pause enforcement of the visa revocation policy while establishing a new system for visa review and termination. Tricia McLaughin, the Assistant Secretary of the Department of Homeland Security (DHS), clarified that the restoration pertains solely to SEVIS access for students whose visas were not revoked initially.
The cancellations have been informally linked to anti-Israel protests on some campuses, although the federal government has not explicitly confirmed this. Secretary of State Marco Rubio noted that participation in activities countering U.S. interests could lead to visa revocations.
At Texas universities, about 100 international students were impacted by the visa cancellations. Recent updates show that several institutions, including Texas A&M and Texas Women’s University, have had some students’ SEVIS records restored. However, responses from other universities, such as UT Dallas and UT Arlington, regarding the number of reinstated students, remain unreceived.
Advocates for free speech argue that the revocations violate constitutional protections. David Loy of the First Amendment Coalition emphasized that "a threat to one person’s freedom of speech is a threat to everyone’s." Immigration attorney Charles Kuck added that many students felt compelled to leave after being informed of their visa cancellations, highlighting the distressing implications of these actions.
