Texas Next in Line to Challenge Google’s Ad Tech Monopoly, Following Virginia Judge’s Ruling


Google is facing legal battles in both Virginia and Texas over antitrust claims. A federal judge in Virginia recently ruled that Google was operating a monopoly over advertising technology. In Texas, Google is fighting against facing a similar trial that includes state law claims. Google is pushing for summary judgment in the Texas case and arguing against a jury trial for antitrust penalties and state law claims.

Lead counsel for the plaintiffs, Mark Lanier, argues that the states are entitled to a jury trial to determine if Google violated state laws. Texas and 15 other states, plus Puerto Rico, filed a lawsuit against Google in December 2020, beating the Department of Justice to the punch. The litigation includes claims for violations of state consumer statutes, allowing for economic damages in addition to structural remedies, with a damage model exceeding $100 billion.

Despite a recent ruling in Virginia that Google was operating a monopoly, Lanier believes it will not impact the Texas case directly. The legal team plans to focus on both state law and antitrust claims independently. In another legal victory for a Dallas technology company, VidStream Inc. won a $105 million verdict against X Corp. Meanwhile, a judge ruled against former President Trump’s executive order targeting a Houston firm, describing it as a “shocking abuse of power.”
